PART - III  

The Gandhidham (Development and Control on   Erection of Buildings) Directions 1982 for development of low-cost-housing in Revenue Survey numbers up to Amendment No. 3 published on 30.12.2005 in the   Gujarat Government Gazette.

In  exercise  of  powers conferred by section  6  of  the Gandhidham  (Development & Control on erection of Buildings)  Act, 1957,  the Gandhidham Development Authority issues  the  following Directions.

1. These   Directions   may  be   called   “The   Gandhidham (Development & Control on Erection of Buildings) Directions, 1982” for development of low-cost -housing in Revenue Survey numbers.

2. These  Directions  shall apply to  lands,  areas  falling outside “GAMTAL”.

Provided that these Directions shall not apply to  Master plan area of Gandhidham, New Kandla, Old Kandla and Shirva.

Provided further that the Development will   be permissible   only   within 1000 meters from the boundaries of “GAMTAL”.

Notwithstanding the above, the said land shall not  fall within the Master Plan area of Gandhidham.

3. “GAMTAL”  shall mean All Revenue free land as may have  been included  by  the Collector of the District within  the  site  of village,  town or City entered before the date of publication  of these  Directions in the Official Gazette but shall  not  include any land which may thereafter be included under the provisions of the  Bombay land Revenue Code in its application to the State  of Gujarat.

4. These  Directions shall be applicable to  Development  of Schemes for socially and economically backward Class of people or for economically weaker sections of the Society and for low-cost-housing undertaken by the Government or Semi-Government Bodies or registered  Co-operative  housing societies or in   on  the  land taken by them from the Government in the area  designated/alloted for this specific purpose or on the land purchased by them.

 

CONDITIONS

 

(a) The provisions of the Direction No.5 complete  shall apply only in respect of plots measuring upto 100 Sq.m.

(b) In case of plots above 100 Sq.m. and upto 200  Sq.m.  all  the Directions applicable for erection of  buildings  within the  Master  Plan area shall be made applicable. A  provision  of  Septic  tank  shall also be compulsry in case of plot  above  100 Sq.m. and upto 200 Sq.m.

(c)  The Co-operative Housing societies shall also  have to obtain permission for development of site.(including change in use of land) as well as erection of buildings from the G.D.A.

(d)  In case of Co-operative Housing society referred to above,  the  said  society shall complete   the  construction  of houses  within  a  period  of 5 years  from  the  date  of  first permission issued by the G.D.A. for erection of houses.

In  case  the  society  fails to  comply  with  the  said requirement,   the   society   shall   have   to   pay   to   the Authority every month a penalty of 0.25ps. per Sq.m. of the  land converted into non-agriculture land.

(e)  An Undertaking to the effect mentioned in  (d)  above shall  be taken from the said Co-operative Housing society  on  a non-judicial  stamp paper of Rs.10/- or on a  non-judicial  stamp paper of the amount as may be revised by the Government from time to time before granting permission for erection of houses.

(a)       If some portion of Survey No. comes within 1000 meter from Gamtal, full Survey No. shall be taken, where development of low cost houses is allowed.

(b)       Periphery roads shall be on two sides only i.e. Gamtal side and opposite side and no periphery road on remaining two sides.

(c)       Internal roads shall not be less than 6.10 meter wide.

(d)       Allotable area shall not exceed 70%.

5.  The  minimum and maximum plot size shall be 40 Sq.m.  and 200  Sq.m. respectively. The development & erection of  buildings on plots measuring upto 100 Sq.m. shall be as under:

(A)

(i) The covered area shall be permissible as given  in Table II under Direction No. 8-A, of the Gandhidham  (Development and  Control on Eraction of Buildings) Directions, 1962, for  row type  of houses.  The said covered area shall be permissible   on each  of the two floors leaving front set back (margin) of  3.0m. In  case of semi-detached building, the side setback (margin)  of  1.5m shall be left.

 (ii) At every 60m. length of continuous plots, 3m. wide space open to sky shall be provided.

 (iii)  The  maximum  number of  storeys  in  a  building constructed  on  the plot shall be ground plus  one  upper  storey only.

 Note:- Construction  of a Barsati shall not be  permissible  in addition to the upper storey.

 (iv) No public amenities, such as underground drainage, water  supply,  roads,  street lights and  a  Health  Center  are compulsorily  necessary.  A provision for a primary school and  a Shopping Center shall be made.

 (B)   (I)  The minimum height of the plinth shall be  45cm.  from ground level.

 (II)  (a) The size of living room or bed room shall be  not less  than  8 Sq.m. with minimum width of 2.4m. and the  size  of kitchen  room if provided separately shall be not less than  5.50 Sq.m. with minimum width of 2m.  In case of one roomed house, the size  of multi-purpose room including space for cooking shall  be not less than 12.50 Sq.m. with minimum width of 2.4m.

 (b)  (i) Size of independent W.C. shall be 0.90  Sq.m. with minimum width of 90cm.

(ii)  Size of independent bathroom shall  be  1.20 Sq.m. with minimum width of 1m.

(iii)  Size of combined bathroom and W.C. shall  be 1.80 Sq.m. with minimum width of 1m.

(c)  The width of balcony, where provided, shall be not more  than 1.00m. and it shall not project beyond the  plot  line and on road or pathway.

 

(III)   (i) The minimum height of rooms shall be as under :

                               Living room         2.6m.

                              Kitchen room       2.4m.

                              Bath/W.C.          2.2m.

                              Corridor             2.2m.

  (ii) In case of sloping roof, the average height of the roof shall be 2.4m. and the minimum height at caves shall be 2.2m.

 

(IV)   The  Opening through windows, ventilators  and  other opening for lighting and ventilation shall be as under :

               (i) One – tenth of the floor area of room.

              (ii) For W.C.and bath each not less than 0.20 Sq.m.

 (V) The  width of stair-case shall be 0.75m.  minimum.  The maximum  height  of riser shall be 20cm. The  minimum   width  of tread shall be 22.5cm. The minimum clear head room of the  stair-case shall be 2.2m.

 (C) Minimum  space open to sky in between the rows  of  houses shall be 6m. in front and 3m. in the rear for public access.

(D)

(i) The minimum accommodation provided in every  dwelling unit  shall be one multi-purpose room of not less than 12.5  Sq.m. floor  area and a W.C. Where there is drainage system, the  agency developing  the  area  shall install  and  maintain  the  internal drainage   system.  Where  there  is  no  drainage  system,   the individual soak pits shall be provided.

 (ii)  The  loft, if provided in a room, shall  not  cover more  than 25 per cent of the floor area of the room.  The  clear head room under such loft shall be not less than 2.2m.

(E)  

(i) Load bearing walls of the building shall be of brick, stone  or  pre-cast  block. In case of  R.C.C.  framed  structure, Fillor walls may be of suitable local materials.

(ii)  Roof of the building shall be of galvanized iron-sheet, asbestos sheets, tiles roof or R.C.C. roof.

(iii)  Doors  and windows of building may be of  wood   or steel.

 

6. In   an  exceptional  case,  any  of  the   conditions   and requirements   laid   down   under  these   Directions   may   be relaxed/waived.

The matter regarding low cost housing in revenue survey nos. was discussed in the Authority in its 114th Board Meeting held on 14-05-2007 and it was resolved that the Gandhidham (Development and Control on Erection of Building) Direction 1982 for development of low-cost-housing in Revenue Survey numbers issued under Section 6 of GDA Act is hereby discontinued. Accordingly following was published on 06-11-2008 in the Gujarat Government Gazette at page 446-2: 

 

The Directions issued under the Gandhidham (Development and Control on Erection of Building) Direction 1982 (PART – III) for development of low-cost-housing in Revenue Survey numbers issued under Section 6 of GDA Act is hereby deleted.

 

However the resolution passed in the aforesaid meeting in this regard is hereby reproduced below:

 3.1     The Gandhidham (Development and Control on Erection of Building) Direction 1982 for development of low-cost-housing in Revenue Survey numbers issued under Section 6 of GDA Act is hereby discontinued. This aspect may be looked into when the complete planning for areas under GDA’s jurisdiction is made.

Applications received for conversion of agricultural land for low cost housing in revenue survey no(s) are rejected where NOC for the same was not given before the cut off date of the present board meeting.
